  1. Scope

These terms cover the streaming of films, events and bonus features on the MyCinema platform –(‘The Platform’) including its subdomains, subpages and mobile applications (apps) - by customers. The following General Terms and Conditions (GTC) apply exclusively in their form valid at the time the contract was concluded.  Streaming within the context of these General Terms and Conditions means the using a film without a permanent copy on your end device. Use of the Platform indicates that you have read, understood and accepted these Terms of Service. If you do not accept these terms, you should not use MyCinema.ie.

MyCinema is a Video-On-Demand (VOD) platform that offers a selection of content – including feature films, event cinema content, interviews and Q&As. It includes free and paid content. Paid content is available to rent and requires payment via PayPal.

MyCinema also provides a portal to highlight and promote new types of events being held in cooperation with partner cinemas. These include gaming & VR events, event cinema screenings, audience choice screenings, and film culture activities such as online film talks.

  1. Statutory rights

All of your statutory consumer rights under Irish and EU law apply for any rentals made on the VOD platform. Nothing in these Terms of Services affects your statutory rights.

Contracts for the streaming of films on the VOD platform are exclusively between you and the Provider. The Provider of the VOD platform is:

The Provider has partnered with a number of cinemas and venues for this project. The contract is exclusively between you and the Provider, even if the transaction is conducted on a cooperating partner cinema's website (subdomain).

Responsibility for the VOD platform lies solely with the Provider. The Provider is responsible for responding to customer queries and offering technical support.

  1. Customer Account

Some content on the VOD platform – such as film trailers, and free bonus content (e.g. interviews) - can be viewed without prior registration. However, the creation of an account is required to stream films or event cinema content via the VOD platform. When registering, users must provide a name and e-mail address. The registration will be confirmed by e-mail. Upon receipt of the confirmation e-mail, a framework agreement for the use of the VOD platform is concluded between you and the Provider.

  1. Termination of accounts

The Provider reserves the right to suspend or close an account without notice if you are found to be in breach of any of the Terms and Conditions.

  1. Ordering Process

You can rent films and event cinema content on the VOD platform. By going through the ordering process, providing the login data and payment information, and sending the order by clicking on the "Order with obligation to pay" button, you submit a binding offer to conclude a usage contract. The contract is only concluded when the Provider provides the service, i.e. when the ordered films are activated for streaming.

  1. Charges

Rental prices are stated on each individual film / content page.

The prices stated at the time of the order apply for all transactions. All prices are final prices in EUR and include applicable taxes such as VAT.

  1. Payment

PayPal is the payment provider for MyCinema.ie.

The Provider does not store any payment information such as credit card numbers and PayPal does not share such payment information with the Provider. More information is available via the MyCinema privacy policy: www.mycinema.ie/privacy

You will receive an email confirmation when an order has been completed.

  1. Streaming of films

The films ordered can be viewed on the VOD platform after the order and payment process has been completed.  

Due to rights restrictions, VOD films and event cinema content are only available to view in Ireland ('the Territory'). Some additional content – such as trailers, interviews or bonus features – may be available internationally.

The system requirements for the platform are:

Windows: x86 or x64 processor with 1.6 GHz or faster (64-bit is only supported for Internet Explorer), 512 MB RAM

Mac: Intel Core Duo processor with 1, 83 GHz or faster, 512 MB RAM

iOS: version 12 or higher

Android: version 6 or higher

These system requirements may change in the future. Customers will be notified of any changes.

Below are the recommended internet download speeds per stream to watch movies through the VOD platform.

0.5 Mbit/s – Min. Required broadband speed

1.5 Mbps - Recommended broadband speed

3.0 Mbps - Recommended for standard definition

5.0 Mbps - Recommended for HD quality

25 Mbps - Recommended for Ultra HD quality

You can achieve the speed of 1.5 Mbit/s with any modern broadband line. Still, there may be disruption if the content is streamed alongside other activities - such as web browsing, checking e-mails or the streaming of other multimedia content – on the same connection or device simultaneously.

  1. Rental period

Details of the rental period will be clearly displayed on each individual film’s MyCinema page. Typically, rentals are available to watch for 48 hours after they have been purchased. Some content may have shorter or longer rental periods – any such cases will be clearly communicated ahead of payment.

Rented content may be viewed an unlimited number of times during the rental period. The content can generally be viewed across multiple devices, but some content may be restricted to a limited number of devices. This will be communicated on an individual film’s page.

You can stop the content and resume watching later at any stage during the rental period. You can pause, rewind or restart the content, but those actions will not extend the rental period.

  1. Copyright

The films offered are protected by copyright and ancillary copyright. For the purpose of streaming, the Provider grants you a simple, limited temporary licence to watch the ordered film in the Territory specified in the film description in the private area for non-commercial purposes as often as desired within 48 hours via the provider's platform. No further usage rights are granted. In particular, the creation of a permanent copy of a film is not permitted.

You are not allowed to misuse the VOD platform. In particular, you may only use the content that has been accessed in compliance with national and international copyright law within the scope of the rights of use granted. In particular, you are not allowed to publicly present the content accessed, to make it publicly accessible, to save it permanently and/or locally, to send, to edit, to disseminate, to reproduce, to distribute or otherwise use it outside of the contractual agreement for a specific purpose in any form.

  1. Term of contract

Either party can terminate the framework contract for the use of the VOD platform at any time.

The contract of use ends automatically upon expiry of the temporary license without the need for notice of termination.

  1. Modification of Terms and Conditions

The Provider reserves the right to change these terms and conditions at any time with effect for the future. The Provider will inform you of the change to the terms and conditions in writing or by e-mail.

In the event of changes to non-essential contractual provisions, your consent shall apply if they do not object to the change in writing or by e-mail within six weeks of receipt of the notification of change. The Provider will expressly inform users in the change notification about the updated GTC and the consequences of the failure to object.

  1. Governing law

These terms and the use of the Platform are governed by the jurisdiction of Ireland for any claim or dispute relating in any way to your use of the Platform.

  1. Cancelling an order

You have 14 days from the time of purchase to change your mind and cancel an order without having to give a reason. However, this only applies up to the point that the content has begun streaming. You cannot cancel an order if you have already started to view the content.

Any refund requests will be processed within 14 days.

If you have any problems streaming content, please contact the Provider using the ‘Contact’ section of the website. We will work with you to try to solve the problem as quickly as possible.

All applicable consumer rights apply to rentals and purchases on the platform.

  1. Age ratings and objectionable material

Some areas of the MyCinema website - including access to particular films - can only be accessed after age verification.

The Irish Film Classification Office (IFCO) age rating for a film will be displayed where available. It may be unlawful for you to access content if you do not meet the recommended age requirement.

The IFCO age ratings are:

G - Fit for viewing by persons generally.

PG - Fit for viewing generally, but in the case of a child under 12 years, under PARENTAL GUIDANCE.

12 - Fit for viewing by persons aged 12 YEARS OR MORE.

15 - Fit for viewing by persons aged 15 YEARS OR MORE.

18 - Fit for viewing by persons aged 18 YEARS OR MORE.

Where an age rating is not available, it is recommended that only people aged 18 or older view the content.

Where ratings are available, the IFCO website will contain an advisory note about the content of a film: www.ifco.ie 

If you are under 18, please ensure you a parent or guardian’s permission before registering an account or submitting any personal information to the Site. If you do not have that permission, you should not register an account or submit any personal information. In the event that MyCinema becomes aware of an account set up by someone under the age of 18 without the appropriate consent, it will be terminated immediately and all data expunged.

Subject to Irish classification laws, films available on the platform may contain content you personally consider to be offensive or objectionable. Some films may also contain explicit material. access CINEMA shall have no liability for material you may consider to be offensive or objectionable.

  1. Links to and from third party websites

MyCinema may contain links and embedded content from sites that are not owned or under control of the Provider. The Provider assumes no responsibility or liability for the content of third-party sites or any third-party material that may feature on the platform.

The Provider also assumes no responsibility or liability for the content of any third-party sites that may link to MyCinema.
